By accessing or using the Service, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to any part of these Terms, you may not access or use the Service.

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

The Service is operated by Miguel's Jr. ("Miguel's Jr.," "we," "us," or "our"), located at 280 Corporate Terrace Cir, Corona, CA 92879. Miguel's Jr. operates fast-casual Mexican restaurants throughout Southern California and provides online ordering, gift cards, catering, and related services through the Service.

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service, you represent that:

• You meet the minimum age requirements.
• You have the legal capacity to enter into these Terms.
• The information you provide is accurate, current, and complete.
• You will use the Service only for lawful purposes and in accordance with these Terms.

You may need to create an account to access certain features, such as placing online orders or managing rewards. When you create an account, you agree to:

• Provide accurate and complete information.
• Keep your login credentials secure and confidential.
• Promptly notify us of any unauthorized access or use of your account.
• Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

When you place an order through the Service, you are making an offer to purchase the items at the listed prices. We reserve the right to accept, refuse, or limit any order at our sole discretion.

Pricing

All prices are listed in U.S. dollars and are subject to change without notice. Prices may vary by location. Applicable taxes and fees will be added at checkout.

Payment

You agree to provide a valid payment method and authorize us (or our payment processors) to charge that method for the total amount of your order. If your payment cannot be processed, your order may be canceled.

Errors

Despite our best efforts, items on the Service may occasionally contain pricing, description, or availability errors. We reserve the right to correct such errors and cancel any affected orders, even after the order has been accepted.

Pickup Orders

You are responsible for picking up your order at the location and time you select. Orders not picked up within a reasonable time may be discarded for food-safety reasons and are not eligible for a refund.

Delivery

Delivery may be fulfilled by Miguel's Jr. or a third-party delivery partner. Delivery times are estimates only, and we are not responsible for delays caused by factors outside our control, such as traffic, weather, or third-party delivery providers. Delivery fees and minimums may apply.

Catering

Catering orders are subject to separate lead-time, deposit, and cancellation requirements communicated at the time of order. Please contact us directly to arrange catering services.

Miguel's Jr. gift cards may be purchased and redeemed at participating locations and through the Service, subject to these Terms and any additional terms displayed at purchase. Gift cards:

• Are not redeemable for cash, except where required by law.
• Cannot be replaced if lost, stolen, or used without your authorization.
• Do not expire and have no service fees, unless otherwise required by applicable law.
• May not be used to purchase additional gift cards.

From time to time, we may offer promotions, rewards programs, discounts, or coupons. Each promotion is subject to its own terms, which we will provide when you participate. In general:

• Promotions may be limited by time, location, quantity, or eligibility.
• Rewards and points have no cash value and may expire.
• We reserve the right to modify or end any promotion at any time.
• Promotional codes may not be combined with other offers unless expressly permitted.

By providing your contact information, you agree that we may contact you by email, phone, or SMS regarding your account, orders, customer service, and (with your consent) marketing communications. Message and data rates may apply.

You can opt out of marketing emails by following the unsubscribe link in any email and opt out of SMS messages by replying "STOP." Note that you may still receive transactional messages related to your orders.

The Service may allow you to submit reviews, comments, photos, suggestions, or other content ("User Content"). You retain ownership of your User Content, but by submitting it you grant Miguel's Jr. a worldwide, non-exclusive, royalty-free, perpetual, transferable, sublicensable license to use, reproduce, modify, distribute, and display your User Content in connection with the Service and our marketing.

You represent and warrant that:

• You own or have the right to submit your User Content.
• Your User Content does not violate the rights of any third party or any applicable law.
• Your User Content is accurate and not misleading.

We may, but are not required to, monitor, remove, or refuse User Content at our sole discretion.

The Service and all content, software, trademarks, logos, and other materials available through it (excluding User Content) are owned by Miguel's Jr. or our licensors and are protected by U.S. and international intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our prior written consent.

When using the Service, you agree not to:

• Violate any applicable law, regulation, or these Terms.
• Submit false, misleading, or fraudulent information.
• Interfere with or disrupt the Service or its servers, including by introducing viruses or malware.
• Attempt to access another user's account or any non-public area of the Service.
• Use automated tools (bots, scrapers, crawlers) to access the Service without our written permission.
• Reverse-engineer or attempt to derive the source code of the Service.
• Use the Service to harass, harm, defame, or impersonate any person.
• Use the Service for any commercial purpose not expressly authorized by us.

The Service may integrate with or link to third-party websites, products, or services (such as payment processors, delivery partners, analytics providers, or social media platforms). We do not own or control these third parties, and your use of them is governed by their own terms and policies. We are not responsible for the availability, accuracy, content, or practices of any third-party service.

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Miguel's Jr. disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, secure, error-free, or that defects will be corrected, nor that menu items, prices, or availability information will be accurate or complete at all times.

To the maximum extent permitted by law, in no event shall Miguel's Jr., its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or related to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total amount you paid to Miguel's Jr. in the six (6) months prior to the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.

You agree to indemnify, defend, and hold harmless Miguel's Jr. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Your violation of any law or the rights of any third party.
• Any User Content you submit.

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease, but the provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and dispute resolution) will continue to apply.

You may stop using the Service at any time. If you have an account, you may close it by contacting us.

These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the State of California, without regard to its conflict-of-law principles. Subject to the dispute resolution provisions below, you and Miguel's Jr. agree to the exclusive jurisdiction of the state and federal courts located in Riverside County, California.

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Informal Resolution

Before filing a claim, you agree to first contact us at questions@miguelsjr.com and attempt to resolve the dispute informally. We will make a good-faith effort to resolve any dispute within sixty (60) days of receiving your notice.

Binding Arbitration

If we cannot resolve a dispute informally, you and Miguel's Jr. agree to resolve any claim arising out of or related to these Terms or the Service through final and binding individual arbitration administered by JAMS under its applicable rules. Arbitration will take place in Riverside County, California, unless you and we agree otherwise.

Class Action Waiver

You and Miguel's Jr. agree that disputes will be resolved only on an individual basis. You waive the right to participate in any class action, class arbitration, or representative proceeding.

Exceptions

Either party may bring an individual action in small-claims court or seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.

We may modify these Terms at any time. If we make material changes, we will provide notice through the Service or by other reasonable means. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Service.

If any provision of these Terms is found to be unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Miguel's Jr. regarding the Service.
